Terms & Conditions
Last Updated: 10 July 2025 · Effective Date: 10 July 2025 · Escapement Lab, George Town, Penang
1. Definitions
- "Escapement Lab", "we", "us", "our" — Escapement Lab, operating from 14A Lebuh Pantai, 10300 George Town, Penang, Malaysia.
- "Service" — any watch repair or servicing programme offered, including Quartz Overhaul and Seal Renewal, Bracelet, Case and Crystal Refinishing, and Chronograph and Complication Restoration.
- "You", "Owner" — the person who brings or sends a watch to the workshop for service.
- "Piece" — the watch or watch component submitted for a Service.
- "Agreement" — these Terms and Conditions together with any written intake record or quotation issued by us.
2. Acceptance of Terms
By submitting an enquiry via this website or leaving a piece at the workshop for service, you confirm that you have read and accept these Terms. You must be at least 18 years of age and have the legal capacity to enter into this Agreement. If you are leaving a piece on behalf of another person or an organisation, you confirm that you have authority to do so.
3. Service Description and Availability
Escapement Lab provides watch repair and servicing from its workshop in George Town, Penang. Services are available to owners who attend in person or make prior arrangements for delivery. We reserve the right to decline any piece that falls outside the scope of our three standard programmes or that presents safety, handling, or sourcing difficulties that we cannot reasonably accommodate.
4. Scope, Quotation, and Changes
All work is scoped and priced before commencement. The published programme prices (RM 480 / RM 1,950 / RM 4,150) cover standard work within the described scope. If something outside that scope is discovered during the job — for example, a cracked movement part requiring specialist sourcing — we will pause and contact you before continuing. No additional cost will be incurred without your explicit agreement.
For case refinishing, the depth of correction is agreed via a sample panel before any material is removed. This agreement forms part of the scope for that job.
5. Owner Responsibilities
- You must have the right to submit the piece for service (i.e., you are the owner or have the owner's authority).
- You must disclose any known defects, prior repairs, or modifications that may affect the work or the cost.
- You must collect the piece within 30 days of receiving a collection notification. After 30 days, a storage charge may apply.
- You must not submit a piece that is subject to an insurance claim, legal dispute, or any matter that would prevent us from working on it legally.
6. Intellectual Property
All content on this website — text, images, layout, and design — is the property of Escapement Lab or is used under licence. You may not reproduce, copy, or redistribute any part of this website without written permission. The watch brands, reference names, and movement calibres referenced for descriptive purposes remain the property of their respective manufacturers.
7. Payment Terms
All prices are in Malaysian Ringgit (RM). Payment is due at collection. We accept cash and bank transfer; other methods may be available — please ask at intake. Work will not be released until payment is received in full. If parts must be ordered in advance for a complication restoration, we may request a deposit of up to 50% of the quoted price before ordering begins. This will be confirmed at intake.
8. Timelines
Quoted timelines — 2–4 working days for quartz overhaul, 7–10 working days for refinishing, and 5–9 weeks for complication restoration — are estimates based on normal conditions. Delays caused by component sourcing difficulties or events outside our control will be communicated promptly. We do not offer compensation for delay unless we have separately agreed a binding delivery date in writing.
9. Your Piece While in Our Care
We take reasonable care of every piece in the workshop. Pieces are stored securely when not on the bench. In the unlikely event of loss or damage caused by negligence on our part, our liability is limited to the repair or replacement cost of the affected component, up to the insured value or the stated value you provide at intake. We strongly recommend informing us of the piece's value at intake and noting any existing damage so the intake record is accurate.
Refinishing and complication work involve inherent risks — polishing removes material permanently, and old movements may reveal additional faults when opened. These are disclosed to you before or during the job, and no irreversible step proceeds without your agreement.
10. Disclaimers
We do not make any representation that a service will restore a piece to any particular condition or rate accuracy beyond what is stated in the programme description. Watch movements are mechanical or electromechanical devices and their performance may vary after service due to age, wear, or conditions outside our control.
This website and its content are provided for informational purposes. Nothing on this site constitutes a warranty, guarantee, or representation regarding any specific outcome.
11. Limitation of Liability
To the extent permitted by Malaysian law, Escapement Lab's total liability to you in connection with any Service shall not exceed the amount paid by you for that Service. We are not liable for any indirect, incidental, or consequential loss — including loss of use of a watch during the service period — whether or not we were advised of the possibility of such loss.
We are not liable for delays or failures caused by events outside our reasonable control, including but not limited to natural disasters, supply chain interruptions, or government-imposed restrictions.
12. Indemnification
You agree to indemnify and hold harmless Escapement Lab and its staff from any claim, loss, or liability arising from your breach of these Terms, including any claim by a third party that you did not have the right to submit the piece for service.
13. Termination of Service
Either party may cancel a service booking before bench work has commenced, without penalty. Once work has begun, you may cancel but will be liable for the cost of work completed and parts ordered to that point. We may decline to continue work at any stage if we discover that proceeding would be unsafe, impractical, or inconsistent with these Terms — in which case we will return the piece in its current state and charge only for work already completed.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Malaysia. Any dispute that cannot be resolved informally between the parties shall be submitted to the courts of Penang, Malaysia, which shall have non-exclusive jurisdiction.
Before commencing legal proceedings, both parties agree to attempt informal resolution by contacting [email protected] and allowing 30 days for a written response. This clause does not prevent either party from seeking urgent injunctive relief.
15. General Provisions
- Entire agreement: These Terms, together with any intake quotation, constitute the entire agreement between the parties in relation to a Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision does not constitute a waiver of our right to enforce it in future.
- Assignment: You may not assign your rights under these Terms. We may assign our obligations to a successor business without your consent, provided the successor agrees to be bound by these Terms.
16. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top of this page will reflect changes. Continued use of this website or submission of a piece for service after an update constitutes acceptance of the revised Terms.
